Terms.
Let it be known that David Platford is trading as Airwurx. From here on 'Airwurx' will used to represent David Platford and/or any person(s) connected to the running of Airwurx. Any reference to ‘you’ implies that ‘you’ are the client/customer and that you have full permission to authorise any work, payments along with use of copyrighted, intellectual property or reference materials, including logos and images required for the given project. The emphasis is on you to provide to anyone, upon request any licences or permissons granted required for use of copyrighted materials. You are taking personal responsibility and accept full liability and exclude Airwurx from any wrong doing in the event of claims and or accusations along with any legal repercussions.
1. Deposit.
Deposits may be required at 25% - 50% of estimated cost. These are non refundable and are deducted from final bill.
2. Mock up designs
Theses are charged at £30 with 1 amendment, further amendments are charged accordingly. These are non refundable and are deducted from final bill if you proceed. There is no obligation to proceed. Payment is prior to mock up being created.
3. Balance/Payment terms:
a) Private clients:
All payments must be made prior to or upon collection.
b) Commercial clients
Payment is due within 7 days of the invoice date unless otherwise agreed in writing.
Invoices not paid by the due date may be subject to statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998, together with
applicable compensation and reasonable recovery costs.
4. Missed Bookings
Missed bookings without prior notification may result in loss of deposit and or extra charges along with no obligation to accept the work.
5. Schedule and Time frames
Every effort is made to meet requested time frames but given the custom nature of the work any finish date or time is an approximation. Some projects may take longer than expected, particularly when incorrectly pre described conditions arise. Unforeseen circumstances and issues can also arise at no fault of you the client, or Airwurx. These can all lead to extended times. Pushed or strict deadlines will attract extra charges.
6. Portfolio Rights
Unless explicitly stated in writing prior to any promise of work, work commencing or deposits being taken, and in addition to any NDA 's all work undertaken is assumed to have been granted permission to be photographed or visually recorded by Airwurx and shared by Airwurx in the public domain in a free to use capacity. This includes before during and after images or details, written or visual text and logos. Images and videos taken by Airwurx remain property of Airwurx. You also grant permission for images or videos of the project used on any other website or platform to be used by Airwurx in any way required. This may include displaying in private and public domains and used in pitching for future work. You have also granted permission either personally or acting on behalf of a company and or agency for whom you are employed by for use of logos within the Airwurx realm.
7. Non disclosure agreements / Confidentiality / Portfolio Restriction Fee
Airwurx can comply with NDA's confidentially and portfolio restrictions but as our work is heavily reliant on our portfolio being displayed we do apply a fee for this privacy. Typically 5% - 30% dependant om restriction criteria.
8. Privacy.
Airwurx does no sell any information submitted to Airwurx. All information submitted via the website contact form is held via WIX and is present within the private wix interface or Gmail. By using the form as point of contact you agree to be contacted by Airwurx in accordance to your preferred method of contact where possible.
9. Delivery.
In the event work must be sent via a third party postal, delivery or courier service which is not arranged by you the client understand information such as name, contact details and address will be used to fulfil the delivery request.
Any extra costs including that of packaging materials, postage, time to pack and arrange delivery will be added on to final price and must be paid prior to booking conformation.
It is strongly advised you arrange your own collection in person wherever possible. No responsibility will fall on Airwurx in the event of loss, stolen or damaged items.
10. Signature
All artwork based projects may carry a 'Dave Platford' signature and/or Airwurx logo. The placement and size of said signature or logo will be at the discretion of Airwurx but please understand this will be done tastefully not to detract for the painted artwork.. Commercial jobs may be exempt. Removal requests may incur extra charges.
